Public prosecutor publishes guide on alternative sentences for Judges
The Moroccan Public Prosecutor’s Office has released a reference guide for judges to accompany the implementation of the new law on alternative sentences, which came into effect on August 22, 2025. This technical and educational document aims to ensure coherent application of measures that promote reintegration, relieve prison congestion, and modernize the judicial system.
The guide aligns with the strategic directions outlined by King Mohammed VI in 2009, emphasizing equity, adaptation to social changes, and openness to alternative mechanisms such as mediation, conciliation, arbitration, and non-custodial penalties.
In his preface, Hicham Balaoui, General Prosecutor of the King at the Court of Cassation, highlighted the central role of public prosecutors in this judicial transition, calling for full and responsible adherence from all judicial actors.
The guide provides a structured framework for alternative sentences, detailing the offenses covered, legal exclusions, and practical procedures for proposal, implementation, and monitoring. It also offers decision-making tools to help magistrates balance societal protection, victims’ rights, and offenders’ reintegration outside prison.
Additionally, the Supreme Council of the Judicial Power has issued a circular to ensure uniform application across courts, avoiding disparities in interpreting the new legal framework.
This guide represents a step towards a more humane, efficient, and modern criminal justice system in Morocco, promoting rehabilitation, social cohesion, and responsible management of penal measures beyond simple punishment.
