ICC Upholds Arrest Warrants for Netanyahu and Gallant

The International Criminal Court (ICC) has rejected Israel’s appeal to annul the arrest warrants for Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant. Despite media reports suggesting otherwise, these warrants remain legally valid and enforceable.

The Appeals Chamber of the ICC dismissed Israel’s request that it should have been notified before the investigation began. However, the Court did agree that the Pre-Trial Chamber should have addressed Israel's challenge regarding the ICC's jurisdiction before the arrest warrants were issued.

Legal expert Professor Triestino Mariniello, who represents Gaza victims at the ICC, clarified that the arrest warrants remain in effect. The Appeals Chamber's ruling does not alter the legal obligation for ICC member states to execute these warrants. While Israel can now formally challenge the Court's jurisdiction, this decision does not change the fundamental issue of the warrants' validity.

Mariniello emphasized that any refusal by states to enforce the warrants would violate the Rome Statute. Looking ahead, he expects Israel to challenge jurisdiction, but believes that the Court will ultimately reject this challenge, allowing the legal process to proceed. Mariniello’s main focus remains on ensuring accountability for those responsible for crimes in Gaza.
